Indian laws on gifting of real estate are simple

The popular perception among non-resident Indians is that Indian real estate laws pertaining to inheritance of acquisition by way of gift are very complicated, but that is not really the case. In fact, they are quite simple.
NRIs and persons of Indian origin can acquire residential or commercial property by way of gift from a resident of India or an NRI. On the other hand, a foreign national of non-Indian origin resident outside India cannot acquire residential or commercial property in India by way of gift.

However, any person resident outside India cannot acquire agricultural land/plantation/farm house in India by way of gift.

In other words, a gift is the transfer of an existing property and not of any future property. It must be made voluntarily and without compensation. It must be accepted by or on behalf of the done. Such acceptance must be made during the lifetime of the donor. The done can even be a minor. Also, the basic element of a gift is that it is given out of natural love and affection.

A deed of gift of an immovable property is required to be registered as provided under the Registration Act signed by or on behalf of the donor and attested by at least two witnesses. The title cannot pass without there being a registered deed of gift.


Sale proceeds of immovable property acquired by way of gift should be credited to a non-resident or NRO, account only. Rules and regulations on gifts very specifically clarify that any ambiguity in terms of process and handover should be avoided. NRIs very often witness such transactions but have no clarity on the process.

India 2nd in Retail Real Estate Investment Momentum Index

India ranks second among top 20 countries with the strongest momentum in retail real estate index and it lags behind China due to weaker investment prospects and a smaller presence of global retailer, according to a report by Cosmic Structure Limited.

In top positions are China, India, Indonesia, Turkey, Brazil and Vietnam,” JLL said in its report released today.

China and India, unsurprisingly, top the Index, due to their favorable demographics, rapid urbanization, strong consumption growth and significant expansion of modern retail infrastructures, it said.

However, the consultant observed that “India falls short of China due to weaker real estate investment momentum and a smaller international retailer presence”.


Although, India has permitted 100 per cent FDI in single brand, it is yet to allow FDI in multi-brand retail.

Is the Real Estate Bubble Big Enough to Naturally Burst in 2014?

One of the primary concerns for the real estate sector in the coming year is very clearly this: Will the much talked-about asset bubble inflates further or will it burst?

2013 was mired in existing challenges such as subdued sales, piles of unsold inventory and builders going bankrupt. These problems will continue in 2014 as well, and, given economic instability, matters could become worse. However, it is very difficult to forecast anything in India as the real estate market is not subject to a fixed pattern. A great degree of political uncertainty, liquidity issues, high interest rates and cautious sentiments are expected to underpin the real estate sector in 2014 too. The only positive energy in this sluggish sector springs from the fact that the sales, though slow, are not stagnant. 

India’s real estate market has been faltering for quite some time as the economy remains under stress. Realty prices have been surging in an unprecedented manner unlike income levels which are not rising. The price increase is mostly speculative and can be attributed to the predominantly capital-driven nature of the sector.


While the cause might be the same at home, the movement of capital across the various geographies in India needs serious analysis. Let us look at each of the significant markets to understand the creation of the asset bubble.

India's real estate market: Time for the bubble to burst?

It is a frequent motto used to emphasize the importance that a location has on the value of a real estate property. The heart of the message is clear -- if you pick the right spot to invest your property in, you can be rewarded with a handsome return on investment.

The Indian economy is in an interesting stage right now. On one end of the spectrum, signs are pointing towards an economic surge. The Sen-sex hit an all-time high a week ago, the RBI seems to be making all the right moves to curb inflation and bring stability to the rupee and analysts can be frequently heard commentating that finally it's a "trading market". This means the economy is picking up, the share market is ripe for investments and therefore investors and traders can take advantage of the opportunities being presented to earn profits.

So all in all, real estate prices or sales are a great indicator of a country's economy.
The RBI has been consistently raising the  rate, which is the rate that banks are charged to borrow from the RBI- in recent months. These past few days, major banks such as State Bank of India and HDFC Bank raised the rates to obtain loans to purchase houses, and the trend is unlikely to stop as the RBI is expected to continue raising rates to fight inflation.


This all translates to bad news for the real estate market. Home-owners will have a more difficult time obtaining loans to purchase houses. Already, cities such as Mumbai are facing a downturn in the real estate market, despite the mass public perhaps not being aware about it.

The latest trend for people trying to raise money for ventures of all types is called crowd funding or crowd sourcing — where people pool their money to support projects ranging from books, movies and other artistic endeavors to software development and Internet start ups.

And of course, it would only seem natural that some entrepreneurs would bring this type of capital raising effort to private real estate deals. In fact, thanks to changes in federal laws related to raising capital, the crowd funding options for investing in real estate are open for business!

But is placing your hard-earned cash into a crowd funding real estate deal a smart and safe way to invest your money? Will you earn money? While it is possible, the odds are highly against you.

First, real estate investing, and particularly development deals, is very high risk. Many things can go wrong with real estate, causing significant financial pain and losses to owners. And these crowd funding deals are primarily for commercial investments, which are the riskiest.


Even if the crowd funded deal you are considering is via an experienced developer or investor, there’s still a chance that the deal will go sour. In some cases, the developer will take large fees out of your “investment,” or your money could be stuck in a deal for years, if not a decade or longer.

Before we dive into the different types of real estate investments that may be available to you, I need to take a moment to explain that you should never buy investment real estate directly in your own name. If someone hurts themselves and sues you, you are on the hook for anything above and beyond the insurance settlement. This could lead to personal bankruptcy or at the very least, significant financial hardship.

There are several ways investors can earn passive income from real estate investments:
Residential real estate investments are properties such as houses, apartment buildings, townhouses, and vacation houses where a person or family pays you to live in the property. The length of their stay is based upon the rental agreement, or lease agreement.

Commercial real estate investments consist mostly of office buildings. If you were to take some of your savings and construct a small building with individual offices, you could lease them out to companies and small business owners, who would pay you, rent to use the property.

Likewise, buying a piece of real estate or a building and then leasing it back to a tenant, such as a restaurant, is more akin to fixed income investing rather than a true real estate investment. You are essentially financing a property, although this somewhat straddles the fence of the two because you will eventually get the property back and presumably the appreciation belongs to you.
